Help With Drugs here?

Hi!

I´m building a list for "Criminals as Main Characters" For TV ( www.listal.com/list/crime-tv ) and I need some help understanding US Drug´s laws.

The thing is: The main character from "The Guardian" is caught with drugs and sentenced for 1500 hours of community service. Is that a felony of a misdemeanor? I guess just possession and use of drugs (heroin if I remember right) isn´t a felony by itself, is it?

I´m not sure if include this tv show or not in the list. Do you think that he was indeed a criminal?

From the U.S. Code Online via GPO Access [www.gpoaccess.gov] [Laws in effect as of January 3, 2007 ] [CITE: 21USC844a] Section 844a. Civil Penalty for Possession of Small Amounts of Certain Controlled Substances

(a) In general

Any individual who knowingly possesses a controlled substance that is listed in section 841(b)(1)(A) of this title in violation of section 844(b)(1)(A) of this title in an amount that, as specified by regulation of the Attorney General, is a personal use amount shall be liable to the United States for a civil penalty in an amount not to exceed $10,000 for each such violation.
